First, you’ll always want to reach out to your equine insurance agent to ensure your release covers you adequately and will be accepted. Generally to use electronic signatures, you need three(3) things:
1.) A written statement on your liability release that both parties agree the document may be electronically signed. We like USEF’s waiver language posted here in their updated June 2020 release:
SAMPLE: “The parties agree that this agreement may be electronically signed. The parties agree that the electronic signatures appearing on this agreement are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility.”
2.) The original form in PDF format, not Word.Why PDF? Because any rider, in any location, can sign a PDF on their phone.
Especially if they have an iPhone. They can attach directly to their STRIDER entry or email to you. and DONE!
3.) An Audit Trail of Delivery. You need proof that the typed name or image belongs to the person it represents. This proof happens automatically when the rider attaches the signed waiver electronically to their STRIDER entry or emails it to you.
Otherwise in two years all you have is a printed piece of paper and the typed signature “Kate Middleton.”
“No, I swear, it was her! Kate walked up to the secretary stand at Dressage For Devon and handed it to us!”
